Requesting and accepting any service of Ondine Illustration confirms that you have read, understand and agree to all of the terms and conditions. The client and artist for hire are bound by these terms and conditions. Breaking any terms within the agreement will result in a permanent blacklisting, excluding you from commissioning any future artwork from me. In some cases, legal action may be taken. (this is just my protection from scammers and art thieves.)
Statements containing "I", "me" or "artist" refers directly to Ondine Illustration. Statements containing "you", "your" or "client" refer to the party reading this document. Statements containing "we" refer to all parties. Terms are subject to change. It is your responsibility to check for updates. Updates will be posted immediately to this web page. 1.Billing I will help clients in the order they submit a commission form. You will not be billed for a commission until I begin working on it. You will be billed 50% of the commission price before I begin. Only after the final 50% is paid in full, I will hand off the finalized artwork with no watermarks. 2.Refunds If you would like to back out of the agreement *BEFORE* I have started, you will receive a FULL refund if a payment has previously been made. If you would like to back out of the agreement and I have already started the commission you are entitled to a PARTIAL refund appropriate to the amount of work that was completed, along with a digital copy of the commission as-is. 3.Process To begin, it is important to provide picture references along with a written description of your request. This may include photos, other artwork, or even your own drawing (artistic skill not required). It is very important that these instructions are clear. If you fail to provide clear instructions, your request may be denied. ( I will work with you to get the information I need, this is only in extreme cases.) After the first payment has been made, you will receive "proof of concept" sketches. This is how I relay to you how I see your idea. You decide the best fitting concept to move on with. You are allowed 3 initial attempts. Any extra attempts will incur a fee +%5 of the full commission cost per sketch. Once our visual concept has been established, I will give you a rough draft of the final. You may edit this draft up to 3 times. Any extra edits will be +%5 of the full commission cost per edit. From here on the idea should be made crystal clear for both of us, I will begin the final draft. Once the final draft has begun no more major edits are allowed. 4.Printing My art is drawn digitally and by nature of the medium the finished artwork is not a physical piece of art. Upon completion, you will receive a digital copy of your artwork. I offer 3 sizes of prints, stickers, and art cards that I produce in my studio that you may order after the completed commission. Ensuring pure authenticity. Every commission will be drawn in a resolution suitable for art prints. Ondine Illustration will be responsible for ordering or creating any prints or products of the commissioned artwork upon request of the client. Prints may be requested at any time, including any time after the commission process is completed. You are allowed to print the digital copy and display at your discretion as long as you abide by the “personal use license” terms stated below. 5.Personal use License I am creating artwork under a strict “Personal use license”. This means you may not alter, sell or take ownership of the artwork in any way. The Artist retains full ownership and rights to the commissioned artwork. Any Intellectual property not created by Ondine Illustration, belongs to the original creators. You may display the unaltered image in a physical or online space as personal brand promotion material. Social media icons, twitch emoticons and character portraits are all examples of ways you can post your commissioned artwork online for personal brand identification. NO PROFITS are to be made directly from the commissioned artwork by means of recreation (digitally or physically) of commissioned material. unless an agreement has otherwise been negotiated. 6. Emergency Termination I retain the right to terminate or postpone a commission at my discretion. Situations that may warrant termination of a commission include: - instances when a client is overly argumentative and disrespectful--resulting in the unnecessary prolonged completion of a commission. -an emergency situation described as, family emergency, act of God, or drastic decline of personal physical and/or mental health. In the event that a situation like this occurs, you will be notified of the change in status of your commission as soon as possible. We will negotiate delay, or you will be offered a refund appropriate to the amount of work that has been completed, along with a digital copy of the commission, as-is if applicable. |
